Signed yesterday by George Osborne to the Prime Minister, Mr Osborne said a ruling in favour of the government was "unlikely" and that "such a step is premature".

The Government wants the appeal against the EU ruling to be thrown out and said he was seeking an extension of its stay.

Mr Osborne's decision to extend the stay was welcomed by Labour MP Jess Phillips, who said it was a "significant statement of resolve from his Government".

Conservative MP Matthew Hancock said: "If the Government fails to take action before the end of next month, it will lose billions in EU funding."

He added: "The Government has made a series of bad decision in this case, but it's still a decision which should stand."

The decision has been widely criticised, with some critics including shadow business secretary Chuka Umunna calling for Mr Osborne to be banned from ever entering the EU again.

The decision comes in relation to the 16.5bn (10bn; $18.7bn) aid package for eastern Ukraine the UK has agreed to provide to Ukraine.

The Foreign Office has said it could take another three months before any further decision on the EU ruling has been taken.

In June, the EU had ordered a 30-day halt on the UK's offer of 40bn aid.

Mr Osborne has said the government could be allowed an additional 60 days to respond, but there is debate within the EU on the decision.

The move comes on top of last week's veto of a European proposal that would grant Russia a financial boost.

The UK would also like to see a suspension in UK investment sanctions over Ukraine until it can negotiate peace with rebels.

Mr Cameron said the UK could withdraw from the EU without a deal if he did not agree a new investment deal.

He said he was "shocked" by the EU ruling, but not in a "vigorous" way.

He said he wanted to talk about it with his counterpart from the European commission and called for "a process that really is fair and realistic and that the UK would like to see".
